Class II Aquatic Plant Permits

Water lettuce (Pistia stratiotes), hygro (Hygrophila polysperma) and ambulia (Limnophila sessiliflora) are listed as Class II prohibited aquatic plants in Rule 5B-64, Florida Administrative Code (F.A.C).

In addition, both hygro and ambulia are included on the federal noxious weed list.

As provided for in Florida Statute 581.145 and Rule 5B-64 F.A.C., Class II prohibited aquatic plants may be cultured in a registered nursery for the purpose of shipping outside of Florida only. However, since hygro and ambulia are listed as federal noxious weeds, you must also obtain a federal permit for interstate movement for those two species in addition to obtaining a state permit.

Steps in obtaining a state permit:

  1. Register as a nursery with the Florida Department of Agriculture and Consumer Services' Division of Plant Industry.
  2. Apply for a permit from the Arthropod, Plant and Plant Pest Movement Permit page.
  3. Submit an Application/Permit to Possess and Cultivate Class II Prohibited Aquatic Plants[ application/pdf ] to the Division of Plant Industry.
