Qualified Energy Conservation Bonds

On December 22, 2017, President Trump signed the Tax Cuts and Jobs Act (HR 1), which makes widespread amendments to the Internal Revenue Code. Section 13404 of HR 1 provides for the repeal of tax credit bonds, including Qualified Energy Conservation Bonds. HR 1 repeals Qualified Energy Conservation Bonds issuances effective after December 31, 2017.

Issuers of Qualified Energy Conservation Bonds issued on or before December 31, 2017, will continue to receive the federal subsidy on their interest payments through maturity. We recommend that you consult with your bond counsel on the ramifications of this action.

Qualified Energy Conservation Bonds provide low-interest federal bonds to state, local and tribal governments for qualified energy projects. Examples of qualified projects include energy efficiency improvements to public buildings, green communities, renewable energy installations, various research and development efforts, efficiency/energy reduction measures for mass transit and energy efficiency education campaigns.
